Terms of Engagement

These terms apply when you engage Homesold Properties for property sales, purchases, rentals or related services.

1. About us

Homesold Properties is a boutique real estate agency operating in Johannesburg North. We are registered with the Property Practitioners Regulatory Authority (PPRA) and conduct business in accordance with applicable South African property law, including the Property Practitioners Act and related regulations.

2. Scope of services

We provide estate agency services including marketing and sale of property, letting and rental management support, buyer and tenant sourcing, market advice, and related administrative assistance.

Specific services, mandate type, marketing plan and fee structure will be confirmed in writing before we commence work on your instruction — typically via a mandate or engagement letter signed by both parties.

3. Your obligations

When engaging our services you agree to:

  • Provide accurate, complete information about yourself and any property involved.
  • Disclose material facts that may affect a transaction, including defects, disputes, encumbrances or pending legal matters.
  • Co-operate with reasonable requests for documentation, access for viewings, and verification required by law (including FICA).
  • Not instruct another estate agent on the same property under a conflicting sole mandate without first resolving the existing mandate.
  • Notify us promptly of any change in your circumstances that may affect an active instruction.

4. Fees and commission

Commission, marketing contributions and other fees are agreed upfront in your signed mandate or engagement letter. Unless otherwise stated in writing, commission is payable on successful conclusion of a transaction in accordance with industry practice and your signed agreement.

Marketing expenses (photography, advertising portals, signage, etc.) will be disclosed before they are incurred. You will not be liable for undisclosed marketing costs.

5. Marketing and listings

By instructing us you grant permission to market your property using photographs, floor plans, descriptions and related media prepared for that purpose. You warrant that you have authority to grant this permission.

We may publish listing information on our website, third-party portals and other channels agreed with you. We will use reasonable efforts to keep information accurate and to remove or update listings when instructed.

6. Confidentiality and POPIA

We treat personal information confidentially and process it in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). Information is used for legitimate property-related purposes and shared only where necessary to perform our services or comply with law.

7. Limitation of liability

We exercise reasonable skill and care in providing agency services but cannot guarantee that a property will sell or let within a particular timeframe or at a particular price. Market conditions, buyer or tenant behaviour and third-party decisions are outside our control.

To the extent permitted by law, our liability is limited to direct losses arising from our proven negligence or breach of mandate, and excludes indirect or consequential loss.

8. Complaints and disputes

If you are dissatisfied with our service, please contact us first so we can attempt to resolve the matter promptly.

You may also lodge a complaint with the PPRA in accordance with its complaints procedure. Nothing in these terms limits your statutory rights.

9. Changes

We may update these terms from time to time. The version published on our website at the time you engage us (or the version referenced in your signed mandate) applies to your instruction.
